1. Agreement to These Terms

These Terms of Use (the “Terms”) are a legally binding agreement between you and PIN2WINGOLF LLC, a Texas limited liability company doing business as Pin2Win (“Pin2Win,” “we,” “us,” or “our”). They govern your access to and use of pin2wingolf.com, Pin2Win accounts, QR-code entry flows, challenge registration, payment access, leaderboards, result submission, and related services (collectively, the “Services”).

By creating an account, accessing the Services, purchasing a challenge entry, checking an acceptance box, or otherwise using the Services, you agree to these Terms, the applicable Official Challenge Rules, the Refund and Payment Issue Policy, and the Privacy Policy. If you do not agree, do not create an account, purchase an entry, or use the Services.

Each challenge may include challenge-specific details displayed before purchase, including its venue, entry fee, dates, attempt window, simulator configuration, prize, and other conditions (“Challenge Details”). The Challenge Details and applicable Official Rules form part of your agreement with Pin2Win. If Challenge Details conflict with the Official Rules, the Official Rules control unless they expressly state otherwise.

2. Eligibility and Texas-Only Availability

You may create an account and enter a prize challenge only if you:

  • Are at least 18 years old.
  • Are a legal resident of Texas.
  • Are physically present at an authorized Texas partner venue when purchasing and completing the applicable challenge entry.
  • Have legal capacity to enter into these Terms.
  • Satisfy the applicable venue’s admission, booking, conduct, and age requirements.
  • Are not prohibited from participating by law or by the applicable Official Rules.

The paid challenge program is offered only in Texas and is void outside Texas and where prohibited. Pin2Win may require reasonable proof of age, identity, residency, physical presence, or eligibility at any time, particularly before awarding a prize or issuing a refund.

3. Nature of the Services

Pin2Win operates golf skill challenges through participating simulator venues. Pin2Win may provide account registration, QR-based access, payment processing connections, challenge codes, attempt records, result collection, verification, leaderboards, and prize administration.

Pin2Win is not the owner or operator of every participating venue and generally does not control simulator reservations, venue admission, food or beverage service, staffing, facility conditions, or unrelated venue charges. Venue bookings and venue services may be governed by separate terms between you and the venue.

Third-party names and products, including Square and simulator platforms such as E6 Golf, belong to their respective owners. Unless expressly stated, those third parties do not sponsor, administer, or endorse a Pin2Win challenge.

4. Accounts

You must provide accurate, current, and complete information, including your real name, email address, phone number, and simulator display name. Your Pin2Win record and simulator record must identify the same participant.

You are responsible for:

  • Keeping your login credentials confidential.
  • Activity performed through your account.
  • Promptly updating incorrect or outdated information.
  • Notifying Pin2Win if you suspect unauthorized access.
  • Signing out of shared devices.

You may not create an account for another person, transfer an account or entry, impersonate another person, share protected challenge codes, or use more than one identity to evade entry or attempt limits. Pin2Win may suspend or terminate accounts reasonably believed to be fraudulent, duplicated, compromised, or used in violation of these Terms.

5. Challenge Entries and Payments

An entry is not valid merely because a payment was submitted. A valid entry requires confirmed payment, creation of a corresponding Pin2Win entry record, satisfaction of eligibility requirements, and completion of the authorized entry flow.

Unless the Challenge Details expressly state otherwise:

  • The entry fee for the initial Hole-in-One Challenge is $20.00.
  • One paid entry provides one eligible five-shot attempt.
  • An entry may be used only by the registered participant.
  • An entry must be used during its assigned challenge and attempt window.
  • An entry or protected event code may not be sold, transferred, shared, copied, or reused.

Payments are processed through Square or another identified payment provider. Pin2Win may receive a transaction identifier, payment status, amount, and related payment metadata, but does not need to receive your complete payment-card number.

If a payment succeeds but a corresponding entry is not created or usable, the payment is eligible for review and refund under the Refund and Payment Issue Policy.

6. Skill-Challenge Conditions

Pin2Win challenges are intended to be bona fide contests that determine golf skill. You must follow the published Official Rules, Challenge Details, simulator settings, venue instructions, and reasonable directions of authorized staff.

You may not:

  • Tamper with a simulator, software, sensor, result, timestamp, network, QR code, or entry record.
  • Substitute another player or allow another person to take a shot for you.
  • Use a false identity or mismatched simulator account.
  • Take extra challenge shots, unauthorized mulligans, or unauthorized practice attempts after the eligible attempt begins.
  • Alter or fabricate screenshots, recordings, witnesses, or other evidence.
  • Exploit a technical error or access a challenge outside the authorized venue or window.
  • Harass participants or staff, damage property, or engage in unsafe conduct.

Violation may result in rejection of a result, disqualification, account suspension, loss of future eligibility, or other lawful action. Disqualification does not create a right to a refund when it results from the participant’s violation.

7. Result Verification and Leaderboards

All displayed results and leaderboard positions are provisional until Pin2Win completes verification. Pin2Win may compare account data, payment records, venue and bay information, simulator records, timestamps, video or screenshots, witness information, system logs, and other reliable evidence.

Pin2Win may correct clerical or technical errors and may reject results that are incomplete, inconsistent, duplicated, manipulated, unverifiable, or obtained in violation of the rules. Pin2Win’s good-faith eligibility and scoring decisions are final to the maximum extent permitted by law, subject to the dispute procedure in these Terms.

8. Partner Venues and Physical Safety

You are responsible for using golf equipment and simulator facilities safely and following venue rules. Golf swings, clubs, balls, simulator equipment, flooring, and activity around a simulator bay involve inherent risks of injury or property damage.

To the maximum extent permitted by law, you voluntarily assume ordinary risks inherent in participating in an indoor golf activity. Nothing in these Terms waives liability that cannot legally be waived, including liability based on conduct for which a waiver is prohibited by applicable law.

Venue reservation fees, cancellation charges, facility incidents, and venue services are generally the venue’s responsibility unless Pin2Win expressly collected or controlled the disputed amount or service.

9. Communications

You authorize Pin2Win to send transactional communications reasonably necessary to operate your account or entry, such as email verification, password recovery, payment status, access instructions, challenge updates, result verification, refund communication, security notices, and potential-winner notices.

Marketing email or text messages, if introduced, will be governed by any additional consent presented when you subscribe. Agreeing to marketing communications must not be required as a condition of purchasing an entry unless legally permitted and clearly disclosed.

10. Intellectual Property and Limited License

The Services, Pin2Win name and branding, site design, software, text, graphics, challenge materials, and other Pin2Win content are owned by or licensed to Pin2Win and are protected by applicable law.

Pin2Win grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Services for their intended customer purpose. You may not copy, scrape, reverse engineer, resell, interfere with, or commercially exploit the Services except as applicable law expressly permits.

11. Participant Content

If you voluntarily submit a result image, video, testimonial, comment, or other content, you represent that you have the right to submit it and that it is accurate and lawful. You grant Pin2Win a nonexclusive license to store, reproduce, and review that content as reasonably necessary to administer the challenge, verify results, prevent fraud, and resolve disputes.

Pin2Win will obtain separate permission before using an identifiable participant’s submitted content in advertising when such permission is required. Challenge participation alone does not require a participant to endorse Pin2Win.

12. Third-Party Services

The Services may link to or interoperate with venues, booking providers, payment providers, simulator platforms, mapping services, social networks, and other third parties. Their services are governed by their own terms and privacy practices. Pin2Win is not responsible for an independent third party’s service except to the extent applicable law provides otherwise.

13. Availability, Changes, and Technical Events

Pin2Win may maintain, update, suspend, or modify the Services. Pin2Win does not promise uninterrupted or error-free availability. If a technical or operational failure prevents delivery of a paid entry or completion of an eligible attempt, the participant may qualify for a replacement attempt or refund under the Refund and Payment Issue Policy.

Pin2Win will not retroactively change a material rule to disadvantage an entry already purchased except when reasonably necessary to address fraud, illegality, safety, or a technical condition that prevents fair administration. Any material change will be communicated as appropriate, and affected unused entries will be eligible for refund.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Pin2Win disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement. Pin2Win does not guarantee that a participant will achieve any result, win a prize, or receive uninterrupted access.

This disclaimer does not exclude any warranty or consumer right that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by law, Pin2Win and its owners, officers, employees, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits or data, arising from the Services or a challenge.

Except for an obligation to pay a duly verified prize or issue an approved refund, Pin2Win’s aggregate liability arising from a particular paid entry will not exceed the greater of the amount paid for that entry or $100.

These limitations do not apply to liability that cannot legally be limited, or to Pin2Win’s fraud, gross negligence, willful misconduct, or other conduct for which limitation is prohibited by law.

16. Indemnification

To the maximum extent permitted by law, you agree to indemnify Pin2Win from third-party claims, damages, and reasonable costs resulting from your fraud, intentional misconduct, unlawful activity, infringement of another person’s rights, damage to venue property, or material violation of these Terms. This section does not require you to indemnify Pin2Win for Pin2Win’s own negligence or unlawful conduct.

17. Informal Dispute Resolution

Before filing a lawsuit, you and Pin2Win agree to send written notice describing the dispute, requested resolution, relevant entry or payment identifiers, and supporting records. Notice to Pin2Win must be sent to pin2wingolf@outlook.com or by mail to the business mailing address listed below.

The parties will attempt in good faith to resolve the dispute for 30 calendar days after receipt of a complete notice. This requirement does not prevent either party from seeking urgent injunctive relief, filing an eligible small-claims matter when a limitations period is approaching, or exercising a right that cannot lawfully be restricted.

18. Governing Law and Courts

Texas law governs these Terms and any dispute, without regard to conflict-of-law rules. After the informal-resolution period, an eligible claim may be brought in a Texas justice court. Any other lawsuit must be brought in a state or federal court with jurisdiction in Bexar County, Texas, and the parties consent to that venue.

These Terms do not presently require binding arbitration and do not eliminate any nonwaivable consumer right.

19. Termination

You may stop using the Services at any time. Pin2Win may suspend or terminate access for a material rules violation, fraud, security risk, legal requirement, or discontinuation of the Services. Provisions that by their nature should survive—including payment, prize, ownership, verification, disclaimers, liability, and dispute provisions—will survive termination.

20. Changes to These Terms

Pin2Win may update these Terms prospectively. The updated version will display a new effective date. Material changes will be communicated reasonably before they apply. The version accepted at the time of a paid entry will continue to govern that entry unless a lawful change is required and affected participants receive an appropriate remedy.

21. General Terms

These Terms, the applicable Official Rules, Challenge Details, Refund and Payment Issue Policy, and Privacy Policy are the complete agreement regarding the Services. If one provision is unenforceable, the remaining provisions remain effective. Pin2Win’s failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without Pin2Win’s consent. Pin2Win may assign this agreement as part of a merger, financing, reorganization, sale, or transfer of the Services, subject to applicable law.
